US Seeks Dismissal in iMEGA Case

At the end of August, the United States government announced that they will move for the case between the US Justice authorities and iMEGA, which has been further postponed to September 26th, to be dismissed.

Earlier this year iMEGA, the Interactive Media Entertainment and Gaming Association, challenged the US on the legitimacy of the UIGEA (the Unlawful Internet Gaming Enforcement act that was made law last October).  They have also asked for a temporary restraining order to be placed on the UIGEA, since the act currently exists without  a regulatory framework.

The reasons for the request of dismissal given by the US are, firstly, 'failure to state a claim upon which relief can be granted' and simply, 'lack of jurisdiction'.  

A spokesperson from iMEGA believes that a dismissal of the case, which is to be held in a New Jersey federal court, is not likely to occur, due to the willingness of the courts to hear oral arguments.  

The UIGEA currently makes it illegal for all types of banking services to facilitate any real money transfers, to and from an online gambling site, made by US citizens.
